Guide for Journal EICs & MEs: Disciplinary Problems

What To Do

In 2013/14, the MLaw Journals Committee adopted the following shared Disciplinary Policy. New members should receive a copy of the Policy upon joining a Journal.

MLaw Journals Disciplinary Policy:

Once a member of a Michigan Law journal receives three disciplinary strikes, the Journal is able to remove the member from his/her position(s) on the Journal. Such a removal will be issued in a meeting with the Director of the University of Michigan Law Library (Kincaid Brown), Head of Scholarly Publishing & Intellectual Access (Jessica Pasquale) and the EIC and ME of the Journal. This meeting will involve a discussion of how the student’s conduct has negatively impacted the Journal.

EICs and MEs of the Michigan Law journals will have the authority to issue strikes based on the following reasons:

  • Failing to attend mandatory trainings and meetings without adequate notice and approval
  • Failing to turn in assignments on time without adequate notice and approval
  • Egregious errors on assignments
  • Failing to treat other journal members with basic respect and dignity
  • Failing to meet any individual journal requirements
  • Any other abuses that an editorial board of a journal has determined are significant.

Each journal will issue strikes in writing to the student within a reasonable time of the infraction.

Challenges to removal decisions will be reviewed by a 7-person sub-committee of the Journals at Michigan Committee, which will be made up with one member of every Michigan Law Journal excluding the Journal issuing the removal. The Journals at Michigan Committee is a group consisting of the EICs and MEs of each Journal.
